Introduction
Welcome to ixHush. These Terms of Service ("Terms") govern your use of the ixHush mobile application ("App") operated by ixHush.app ("we," "us," or "our"). By downloading, installing, or using our App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our App.
Use of the App
ixHush is a white noise and sound mixing application designed to help users create custom sound environments for relaxation, focus, and sleep. By using our App, you agree to:
- Use the App only for its intended purposes
- Not attempt to reverse engineer, decompile, or modify the App
- Not use the App in any way that could damage, disable, or impair the App
- Not attempt to gain unauthorized access to any part of the App
Intellectual Property
The App and its original content, features, and functionality are and will remain the exclusive property of ixHush.app and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ixHush.app.
User Content
Our App may allow you to create and save custom sound mixes. You retain all rights to such content. By creating and saving content within our App, you grant us a non-exclusive, royalty-free license to use, store, and display your content in connection with providing the App's services to you.
Subscriptions and Purchases
Our App may offer subscription services and in-app purchases. By subscribing or making purchases:
- You agree to pay all fees and charges associated with your account
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- Subscription cancellations take effect at the end of the current billing cycle
- Refunds are governed by the policies of the app store through which you downloaded our App
Disclaimer of Warranties
The App is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that the App will always be available, uninterrupted, or error-free. While our sounds are designed to aid relaxation and sleep, we make no medical claims about their effectiveness and they are not intended to replace medical advice or treatment.
Limitation of Liability
To the maximum extent permitted by law, ixHush.app shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the App, including but not limited to loss of profits, data, or goodwill.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
